1. About these terms

These Terms govern EveryGen AI at everygenai.video, including the video studio and related services. “We” refers to the service operating under the EveryGen AI brand. Support, billing, and legal enquiries can be sent to hello@everygenai.video.

Creating an account or using the service means you agree to these Terms. If you disagree, do not use it. Our Privacy Policy explains personal information handling; accepting these Terms is not blanket consent to optional tracking or every use of personal data.

2. Eligibility and accounts

You must be at least 18 and legally able to enter a contract. For organisational use, you must have authority to act for that organisation. Provide accurate account details, keep credentials secure, and report suspected unauthorised access. Do not sell accounts, share credentials publicly, or access another person's account without permission.

3. The video service

The studio sends prompts and, for supported models, reference images to third-party AI services through Kie. Model availability, duration, resolution, audio, queue time, and supported inputs depend on the selected model and the settings shown in the studio. Listing a model does not guarantee uninterrupted access or a particular result.

We may change features for security, legal, or provider requirements. Where practicable, we will give notice of material changes affecting paid services. Applicable consumer remedies remain available.

4. Your inputs and permissions

You retain rights you already hold in your prompts, images, and other inputs. You must have the rights and permissions required for us and the selected providers to process them, including permissions from identifiable people where required. Do not submit credentials, confidential documents, or unnecessary sensitive personal information.

You give us a limited, non-exclusive permission to transmit, store, reproduce, and process inputs and results as needed to provide the requested service, maintain history, handle support, and prevent abuse. This does not transfer ownership or authorise featuring your private tasks in our public gallery or advertising; public promotion requires separate permission.

5. AI output and commercial use

As between you and us, we do not claim ownership of rights you may lawfully hold in generated output. This does not create copyright that does not exist, override model terms, or grant rights in third-party brands, characters, faces, or music.

Output may be inaccurate, unsuitable, similar to other users' output, or infringing. We do not guarantee uniqueness, exclusivity, copyright protection, or unrestricted commercial use. Review inputs, model conditions, and the result before publishing. You are responsible for required AI disclosures and for not misrepresenting generated footage as an authentic recording.

6. Acceptable use

Do not use the service to:

  • Break the law or infringe copyright, trademarks, privacy, publicity, or other rights.
  • Create sexual content involving minors, non-consensual intimate imagery, or exploitative depictions.
  • Commit fraud, deceptively impersonate people, fabricate harmful evidence, or conduct harassment or discriminatory abuse.
  • Distribute malware, steal credentials, bypass moderation or access controls, or obtain other users' data.
  • Overload the service, exploit billing errors, evade limits, or resell access without permission.

Providers may apply additional restrictions. We may refuse or suspend requests violating these Terms or model rules. A moderation refusal does not itself decide whether content is lawful.

7. Kie and third-party models

Generation sends your prompt, reference URLs, and parameters to Kie and the relevant model services. Their availability and processing are outside our direct control. Review Kie's Terms of Use, Privacy Policy, and any conditions supplied for your selected model.

Third-party names and trademarks identify compatible services only. They belong to their owners and do not imply partnership, sponsorship, or endorsement.

8. Credits and failed tasks

Check the displayed generation credit cost before submission. The server validates your model and settings and calculates the charge. Credits are service usage units, not currency, deposits, investments, or transferable assets.

Credits are reserved when submitting a task. A confirmed provider rejection or terminal failure returns that task's generation credits. A timeout or disconnected submission may be uncertain, not failed: credits can remain reserved while we check whether the provider accepted the request. Contact support with the task ID and avoid duplicate submissions during uncertainty. A technically successful result that differs from your creative expectations is not automatically a failed task.

Credit expiry, promotional limitations, and plan-specific rules must be disclosed with the relevant offer. Returning credits is different from refunding a payment.

9. Payments, renewals, cancellation, and refunds

This section applies when paid checkout or subscriptions are available. The offer and checkout should disclose price, currency, applicable taxes, included features or credits, billing frequency, renewal conditions, and any expiry before purchase. Homepage examples are not binding paid offers.

Recurring billing requires an explicitly recurring plan. Request cancellation through available subscription controls or our email. Unless the offer or applicable law says otherwise, cancellation stops future renewals without reversing usage already delivered.

Report incorrect, duplicate, unauthorised, or undelivered charges with your account email and order reference. Do not email full card details. Refund requests are assessed against the purchase terms, delivery, and applicable law. Mandatory refund, withdrawal, and cancellation rights are not excluded.

10. History and result links

The studio shows recent tasks, not a permanent archive. Provider-hosted result links may expire. Download and securely back up outputs you want to keep. We do not currently promise automatic transfer to our own storage, unlimited retention, or recovery of expired links. Public reference and result URLs may be accessible to anyone who obtains them; do not use them for confidential material.

11. Website materials and examples

Our branding, interface, and original website materials are protected to the extent permitted by law. Third-party material remains subject to its owner's rights. Demo clips, reference portraits, and concept images do not grant reuse rights or prove our service or a displayed model generated them. Observe the reference/demo labels on examples.

12. Suspension and account closure

We may restrict access where reasonably necessary for security incidents, unlawful use, material breaches, fraud, or provider restrictions. Where safe and practicable, we will explain and offer a way to request review. Suspension does not remove mandatory refunds or data rights.

Request closure or deletion by emailing hello@everygenai.video from your account address. Support handles these requests; there is currently no automatic self-service deletion button. We may verify requests and retain records needed for legal obligations, transactions, or disputes, as explained in the Privacy Policy.

13. Service limitations and responsibility

AI generation is experimental and the service is provided on an “as available” basis. We cannot guarantee uninterrupted service, error-free output, suitability for a creative purpose, or continued availability of third-party models.

To the extent legally permitted, we are not responsible for indirect or consequential losses from reliance on AI output or third-party outages. Nothing excludes liability that cannot lawfully be excluded, including applicable consumer protections, fraud, or intentional misconduct. No blanket waiver of statutory rights is intended.

14. Concerns, rights reports, and disputes

Email concerns or disputes to hello@everygenai.video. For infringement reports, identify the content, the right involved, your contact information, and your authority to report. Avoid unnecessary sensitive information.

We encourage initial resolution through support. These Terms do not impose mandatory arbitration or an exclusive foreign court. Applicable mandatory law and non-waivable consumer rights remain in effect; no unconfirmed corporate jurisdiction is designated here.

15. Changes and contact

The revision date appears above. Material changes will be communicated through the service or another reasonable channel where applicable; changes are not intended to remove accrued rights retroactively. If you disagree, stop new use and contact us about closure and outstanding matters.
